The ever-changing employment legislation landscape can be tricky to navigate and earlier this year a new, related, change came in.

Under new WHS legislation, employers now have an obligation to prepare and implement a Prevention Plan to manage identified risks of sexual harassment and sex or gender-based harassment in the workplace.

These new requirements are about taking a purposeful and structured approach to creating workplaces where everyone feels safe and respected. (It isn’t just about avoiding penalties although, businesses can face fines for not having a Plan).

To help you keep your compliance in check, we can cut through the jargon and guide you through a simple, logical process to develop a Sexual Harassment Prevention Plan that works for your business.

First up, what are the changes and what needs to be in the plan?

From 1 March 2025, all employers are required to have a Prevent Plan in place. (all the details can be found on the WorkSafe website)

Here’s what your Plan needs to cover:

  • What the risks or potential risks are in your workplace
  • What you’re doing about them – things like policies, or risk-reducing practices in the way you work
  • What you’ll do if there is an incident – things like reporting processes
  • Consultation with your team - involving your team in the plan development is a key requirement
  • How the plan is shared and reviewed.
